There is an ongoing increase in both the number of Freedom of Information and personal data requests to Schools either in isolation, jointly or in forming part of a complaint. In order to ensure support is available to address what can be very time-consuming requests, the SLA offered is as follows.

Provision of Complaints and related advice to schools

Schools have a responsibility under section 29 of the Education Act 2002 to have in place a procedure to deal with complaints. The service will provide general advice to schools on the complaints procedure and related processes and detailed advice on good complaints management including vexatious complaints and managing forensic investigations when they are required. The service will also provide advice on setting up and running Governor’s complaints Panels. If necessary or required, visits to schools are available.

Information governance

Schools are Data Controllers as defined by the Data Protection Act 1998, the Freedom of Information Act 2000, Environmental Information Regulations 2004 and Privacy and Electronic Communications Regulations 2003. The service will provide advice and assistance to schools on the management of their responses to Data Access requests and Freedom of Information enquiries. It will also provide advice to the schools on the following: Records management, Information Governance, the Data sharing code of Practice, CCTV code of practice, safeguarding personal information, protecting privacy – promoting openness, publication schemes, privacy notices and managing enquiries and complaints from the Information Commissioner. If necessary or required, visits to schools are available.

Training and briefing courses are offered to all schools via Training & Development Service however those schools that are part of this SLA can request school visits for briefings or specific topic discussion.
